Thank you to Lisa Power of the Terrence Higgins Trust for providing further figures on the current state of claims.

As of 10th October 2008 - this relates to HIV cases.

2300 claims have been cleared by the DWP - this means processed.

of these

41% were moved to "Normal Rules" and maintained the rate of DLA.

4% or 90 people were left on "Special Rules", no change.

22% of claims were disallowed.

1% of claims saw an increase in DLA awarded

32% had a reduction in their DLA award.

re: dla claims moved to normal rules

 Would someone explain to me how you would know if your review was moved to normal rules or left on Special Rules. My review came back just telling me that "there will be no change to the amount of money we are paying you" and not mentioning anything about being taken off from "special rules". If one was on Special Rules would you be told if you were changed to Normal Rules? Thus would I be correct to assume that I have been left as I was before having to complete the full review?

How you are moved to "Normal Rules".

If you completed your DBD551 and you were then written to saying there would be no change you remain on "Special Rules".  This happens if the determination is that you will not survive longer than 6 months.

If after you completed your DBD551 the DWP asked for more information and gave you a DLA556 form to complete. An award on the basis of your completed DLA556 is a decision made under "Normal Rules".

Thanks for the concise reply. I now understand that I have been moved.... alas, I almost "liked" being special!! But rejoice that I can look forward to more than 6 months left to live.

dla reviewed

hi john just to let you kno that my review has now been completed after 10 monts of waiting since the first letter, i received a call from the dla today to inform me that my benefits would remain unchanged, its such a relief after all these months of worry, thanks to your site i never felt like i was facing it alone, keep up the good work and i will continue to reccomend your site to other facing the review, andalso good luck to everyone else thats facing the review i wish you all the best
